Property matters include many different aspects of law, from buying and selling residential or commercial properties to moving a tenant into a buy to let property.


ADVERSE POSSESSION

Our property department has an excellent record with regard to such cases. If you have been in possession of a parcel of land for more than ten years (registered land) or twelve years (unregistered land) and you have maintained that land to the exclusion of all others then you may have a case for adverse possession.

The criteria is quite strict and each case is decided on its own merits but we offer a first free interview to assess any likelihood of success should a claim be made.

COMMERCIAL CONVEYANCING

For our business client, we also offer advice and assistance for commercial transactions. These can include the sale and purchase of commercial premises, for example shops, factories, public houses or restaurants.

We can also assist with the granting or taking of a lease of commercial premises. These situations can be complex and time consuming, especially in relation to the obligations of the landlord and the tenant, rent reviews and dilapidations of the premises. There may also be queries regarding any Stamp Duty liability attached to the taking of a lease which we can advise you on.

Our expertise is not limited to the conveyancing process. We also have experience with planning applications and have a close working relationship with local financial advisers who will provide advice on any taxation issues that may arise.

LEASES AND TENANCIES

Leases and tenancies can cover a wide range of situations both in a commercial and residential context. We can advise on matters ranging from long leases of houses or commercial properties to shorter term leases of shops and restaurants. We also have experience in dealing with tenancy agreements and less formal arrangements such as licences to occupy.

We can provide advice to you whether you are a landlord or a tenant. We can confirm the responsibilities of each party under the terms of the relevant document, for example in relation to repairs or rent reviews. If relations sour, we can also advise the landlord or tenant on how to end the lease or tenancy.

RESIDENTIAL CONVEYANCING

Buying a property is one of the most important and life changing decisions you will ever make. It can be confusing and complex and is famously referred to as one of the most stressful times of your life.

Our aim is to take the stress out of moving for you. We have links to local businesses and can advise you on where to find a mortgage and where to obtain a survey amongst other things. We will keep you updated as to how the matter is proceeding and what remains outstanding. We offer a personal conveyancing service from the time you contact us until the formalities have been attended to, namely registering the property in your name.

We also undertake house sales. We will prepare the contracts, instruct an Energy Performance Certificate to be prepared (if necessary) and ultimately arrange for any mortgages to be redeemed on completion and the balance forwarded to you as swiftly as possible.

REMORTGAGES

Many people consider remortgaging their homes for a variety of reasons. These can be because the fixed rate on their current mortgage is coming to an end or because they want to release some of the equity in the property, perhaps to fund a buy to let purchase.

We offer a quick and effective remortgage service. We obtain the necessary searches required by the mortgage company, investigate the title to the property, repay any mortgages currently on the property and ultimately forward the balance of any money remaining upon completion to you.

TRANSFER OF EQUITY

We can provide advice regarding either adding or removing a name from the title to a property or a mortgage. This is often attended to in the course of matrimonial proceedings.
